Terms of services for Haven Application

1. Introduction

The Haven application offers a personalized subscription service to its users allowing them to access media entertainment content (hereinafter referred as, « Haven content ») via internet, on any connectable devices (hereinafter referred as, « Haven compatible devices »).

The terms « Haven service », « our service » or even « the service » refer to the individual and customizable service offered by the Haven application to its users through the meaning of our functionalities, our recommendations and selections, our website, the user interface and all other software or content related to any provided services.

The terms « you » or « the user » refer to the owner and creator of the account on our platform responsible for all subscription payments and their completion by the method of its choosing.

The Haven service is provided by (Manga&Stories4All Sàrl, Avenue du Midi 37, c/o Fid-Conseil SA, 1700 Fribourg, Switzerland), (hereinafter referred as, « we » or « us »). These Usage Conditions are signed between you and us, and regulate your usage and access to our services, contents and the Haven platform.

2. Haven service and offer

2.1. Are only allowed to use our services and access our platform and Haven content, users who meet the following requirements: (1) Have 13 years of age (or the equivalent minimal age in your country of origin), (2) In the case of an age inferior to the majority age in your country of origin, have the agreement of one of the legal representatives (3) Have the ability and right to sign a binding contract with us. You further warrant that all information entrusted to us, at the moment of your subscription, is truthful, exact and complete and that you undertake to do the necessary so that it remains truthful, exact and complete.

2.2. We reserve the right to limit and restrain the sensitive content exposed to minors of age.

2.3. We reserve the right to limit, restrain, select or modify the content exposed varying on the geographical location of the user.

3 Cost-free access and advertisement

3.1. Haven base service is a free of charge offer provided by default to all users with no additional costs and may present unavoidable advertisement screens before accessing Haven contents and at certain intervals. The user acknowledges and consents to the presence of such advertisement screens and the transactional nature of the offer.

3.2. We reserve the right to freely select the type, frequency and nature of all displayed advertisements and to limit or unable their display for specific users.

4. Haven service usage

4.1. To use our service, you must have reached the age of majority in your country of origin. Minors of age may, however, access our platform under adult supervision.

4.2. Our service and all content accessed through our service is for personal, non-commercial use, only, and may not be shared with people exterior to your household. In any case, you consent to not use our Haven service for public projections.

4.3. For the period of your subscription, we grant you a non-exclusive, revocable, non-assignable, non-transferable and limited right to access our Haven service and content. Except all the above, no right, title or interest is given to you.

4.4. You may only access our content in countries where we provide our services and have the corresponding licensing rights. As such, content availability on the Haven application is dependent on geographical location.

4.5. Unless expressly authorised by us, you warrant not to:

Archive, reproduce, distribute, modify, display, produce, publish, concede, sell, create derivative work or utilise the Haven content or information relative to, or obtained through our Haven service
Bypass, remove, modify, deactivate, block, mask or thwart Haven content protections or any other elements constituent of our service and application, including the graphical user interface, the copyright notices and trademarks
Use robots, indexing robots, web crawlers or any other automated methods to access the Haven service
Decompile, reverse engineer or disassemble any software, product or process accessible through the Haven application
Insert any code or product, or manipulate the Haven service, in any way or form
Use any method of exploration, collection or extraction of data
Download, display, send by e-mail or by any other way, content with the intention to interrupt, destroy or restrict the normal functionality of any software, hardware or telecommunication equipment related to our service, including viruses, code, files or any program.

4.6. We reserve the right to restrict access to our service if the user violates these terms or makes an illegal or illegitimate use of our service.

4.7. Our software has been designed to offer a personalized and adaptable service. Haven features and functionalities have been adjusted to fit, as intended use, the greatest possible range of devices, and may present variations in usage and dysfunctionalities, relative to device.

4.8. Your password is restricted to personal use only and must remain confidential. By giving others, the ability to access your account and information relative to your account, you accept to take responsibility, on your behalf, for any actions or alterations made by such third persons, including disclosure of private information.

4.9. To assist in keeping control of your account and prevent any unauthorized user access, you warrant that you will retain all devises used to access our services under your direct control and that you will not share account related data nor any information susceptible to be used to illegitimately gain access over your devices and Haven account. In the event of identity theft or any fraudulent activity, you agree to concede us the right to terminate or suspend your account in order to protect you, our partners and ourselves.

5. Miscellaneous

5.1. The present Terms of Use shall be governed by and construed in accordance with Swiss law. Nonetheless, the present Terms of Use shall never limit or prejudice imperative provisions regarding consumer rights that you may have in virtue of your country of residence legislation.

5.2. Some jurisdictions do not allow the exclusion of implied warranties or limitations on a consumer’s applicable legal rights. Therefore, the following exclusion and limitations may not apply to you and will not affect your statutory rights. We undertake to deliver the Haven service using reasonable care and competence and in conformity with all the specifications we have provided. Except the aforementioned, the Haven service is delivered on an “as is” and “as available” basis, without any express, implied or statutory warranties on our side. Furthermore, we exclude all express, implied or statutory warranties regarding the content offered by our Service. This applies in particular to warranties as to the quality of the content, such as the warranty of satisfactory quality, the warranty of fitness for a given particular purpose, or the warranty of authenticity of the content provided. Nor do we warrant that the Haven application is free of malware or harmful components. We do not assume responsibility for third-party applications and software (or associated contents) promoted, publicized or proposed by third parties on or via our service. We do not take any responsibility for transactions between you and the third-party providers of such applications and software.

5.3. If one or more provisions of these Terms of Use are found to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.

5.4. We reserve the right to modify these Terms of Use. In the event of significant changes, we will notify you at least one month before such changes take effect. If you do not wish to accept these modifications, you may contact us to terminate your account. Otherwise, use of your account constitutes acceptance.
